VIRGINIA: E&S CARRIERS NOT REQUIRED TO COMPLY WITH CLAIMS MADE PROVISION
In response to a question to the Virginia Bureau of Insurance regarding the Rules Governing Claims-Made Liability Insurance Policies (14 VAC 5-335-10 et seq. of the Code of Virginia) and, specifically, whether this regulation applies to surplus lines carriers, the Bureau of Insurance has taken the position that their statutes and regulations that have coverage requirements or rate and form filing requirements do not apply to surplus lines policies. Consequently, the Bureau indicated that surplus lines carriers are not required to comply with the provisions contained in this regulation.
